THE GIFT TAX The gift tax may apply to any transfer of money or property by a party where no consideration (payment) is received in return. These rules apply no matter who makes a gift a parent or anyone else; however, to keep the discussion simpler, the person making the gift will be referred to as the parent. The gift tax is applied in a very broad and allencompassing manner so that a gift of any property, whether direct or indirect whether it is money, personal property (furniture, a car, draperies, and so forth), or real estate can trigger the tax. The simplest way to conceptualize the gift tax is that when a parent makes a gift subject to tax, the gift tax rate is applied and the tax paid. Unfortunately, the calculation is a bit more complicated. The gift tax is based on all taxable gifts a parent makes during his or her lifetime. Thus, the gift tax calculation is different from the income tax in at least two important ways: (1) each parent has his or her own gift tax calculation even if the two f ile their income tax return together; and (2) this calculation is generally based on gifts over an entire lifetime and not on each year alone, as is the federal income tax. Thus, to calculate the gift tax due, the parent making the gift uses the following general approach: 1. Add up all taxable gifts made in all prior years and the taxable gifts made during the current year (i.e., on cumulative lifetime transfers). 2. Calculate the gift tax on the amount obtained in (1) using the gift tax rate schedule.
